Waiver

PARTICIPANT WAIVER, RISK WARNING, RELEASE AND INDEMNITY

Spectrum Jiu Jitsu Sports Combat (also trading as Spectrum Sports Combat) of 7/50 Heaths Court, Mill Park VIC 3082 (“Spectrum”, “we”, “us”).

By ticking I agree and typing your name, you (or, if the participant is under 18, you as parent or legal guardian) enter a legally binding agreement. Do not agree unless you have read it.

WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012 (VIC)

If you sign this form, you agree that you are giving up your rights to sue us if you are injured because of our negligence or failure to take reasonable care. You are agreeing to waive your rights under the Australian Consumer Law and Fair Trading Act 2012. The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on our part. “Gross negligence”, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 6 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22 of the Australian Consumer Law and Fair Trading Act 2012.

1. Activities. Training and related activities at Spectrum include Brazilian jiu-jitsu, wrestling, mixed martial arts, boxing, Muay Thai, K-1 / kickboxing, striking, sparring, open mat, strength and conditioning, private lessons, seminars, competitions, and any associated warm-up, drills, or events on or off the mats (“Activities”).

2. Risk warning (Wrongs Act 1958 (Vic)). The Activities are dangerous recreational activities. They involve obvious and inherent risks, including uncontrolled contact, takedowns, joint locks, chokes, strikes, collisions, falls, equipment failure, infection, and injuries from other participants or from your own conduct. Harm can include bruises, sprains, fractures, concussion, spinal injury, paralysis, brain injury, and death. Not all risks can be removed, even with coaching, rules, mats, and first aid. This clause is a risk warning for the Wrongs Act 1958 (Vic) (including sections 53–56) and similar laws.

3. Voluntary assumption of risk. You participate (or you permit the child to participate) voluntarily and accept those risks.

4. Fitness and disclosure. You confirm the participant is physically able to train, will tell coaches about injuries or medical conditions, and will stop if they feel unwell. Spectrum is not a medical provider.

5. Rules. You will follow coaches’ directions, gym rules, and tap / safety protocols. Reckless or dangerous conduct may mean you are asked to leave.

6. Release. To the maximum extent permitted by law, you release Spectrum, Ryan Barry, coaches, staff, contractors, and other participants from claims arising out of the Activities, including injury, death, or property damage, including claims in negligence, except to the extent we cannot exclude liability (including for gross negligence as defined above, or any other liability that cannot be excluded).

7. Indemnity. You indemnify Spectrum against claims arising from your (or the child’s) participation or breach of this waiver, except to the extent caused by Spectrum’s gross negligence.

8. Minors. If a participant is under 18, the parent or legal guardian signs once for every child named on this form, accepts the risks on each child’s behalf so far as Victorian law allows, and agrees they and each named child are bound by this waiver.

9. Photos and video. Spectrum may photograph or film classes for the gym, website, and social media. Tell us in writing if you do not want the participant shown.

10. Personal information. Name, email, phone, and related details are used to run membership, billing, and gym communication, including events if you opted in. Contact spectrumbjjsc@gmail.com to update or opt out of marketing.

11. Electronic signature. Ticking I agree and typing your name is your electronic signature and the legal equivalent of a handwritten signature, under the Electronic Transactions (Victoria) Act 2000. A record (your details, the waiver version, time, and signature name) is emailed to Spectrum. You may request a copy.

12. Governing law. Victoria, Australia. If a clause is unenforceable, the rest remains in force. This waiver applies to this visit and future training until you sign a replacement.
